We at Kaross Travel Pty Ltd. look forward acting as your booking agent for all your travel needs. These terms and conditions (the “Agreement”) describe what you are legally entitled to expect from us when you purchase travel related services through us, as well as your obligations as a customer. The terms “we”, “us” and “our” refer to Kaross Travel Pty Ltd herein often referred to as Kaross. The term “you” refers to the customer booking a reservation through us or otherwise using our services.
Please read the following terms and conditions carefully. You must not make any booking unless you understand and agree with the following terms and conditions.
Booking Terms & Conditions
We at Kaross Travel Pty Ltd. look forward acting as your booking agent for all your travel needs. These terms and conditions (the “Agreement”) describe what you are legally entitled to expect from us when you purchase travel related services through us, as well as your obligations as a customer. The terms “we”, “us” and “our” refer to Kaross Travel Pty Ltd herein often referred to as Kaross. The term “you” refers to the customer booking a reservation through us or otherwise using our services.
Please read the following terms and conditions carefully. You must not make any booking unless you understand and agree with the following terms and conditions.
These terms and conditions apply to all enquiries, advice, quotations or estimates made, provided by or bookings made with and/or all services rendered by or on behalf of Kaross (‘the Travel Agent’).
Deposits and Payment
Any deposits paid by you are non-refundable. Payment of a deposit enables us to hold a reservation for you but does not guarantee the price. The price can only be guaranteed once we receive full payment and other travel documents have been issued, subject to any terms and conditions of the Supplier. We will advise you of the date that full payment is required. Upon provision of your payment information, you authorize us to make the payment arrangements with the corresponding Suppliers.
We reserve the right to refuse personal cheque as a method of payment. After full payment, the conditions of the contract with your Supplier may permit them to increase the cost of your arrangements. If we are acting as your Booking Agent, we will pass on any such increase to you as we become aware of it. If we have arranged a package, changes in transportation costs including the cost of fuel, taxes, fees and exchange rates mean that the price of your travel arrangements may change after you have paid in full.
* In the case of air tickets, full payment is required as per the applicable fare rule. If full payment is not received by the applicable date the airline will automatically cancel the reservations.
Passports & Visas
Passports are required for all passengers including infants for international travel. Your passport must be valid for at least 6 months after your date of return. Entry into the visiting country will be denied if your passports expire before the 6 month period. All travel documents need to be in the name appearing on your passport. If any traveller’s passport has not been issued by the Department of Home Affairs at the date of completing the booking form you hereby indemnify Kaross against any errors that might occur and costs relating thereto.
If you are South African permanent resident, travelling on a foreign passport, you must make sure you have the right documentation from Home Affairs to travel. It is important to let your consultant know which passport you will be travelling on.
Should you be a dual passport holder, please ensure you travel with both valid passports.
With regards to domestic travel – All travel documents must be in the name which appears on your identity documents and identification is required for infants.
It is the clients’ responsibility to check visa requirements with the consulate or embassy of each country being visited including any stopovers/ports and transits. Check all border crossings, especially if you are on a cruise, you may need a visa according to the maritime law of the country concerned. Kaross cannot be held liable for any claims resulting from a country refusing entry and can also not be held liable for incorrect advice given by visa companies, embassies or consulates. Kaross cannot be held liable for any claims related to work visas.
It is the responsibility of passengers to ensure their children have the correct documentation or risk being denied boarding. The new law will be enforced by airlines and immigration officials across the board (land, sea and air). Although airlines and travel agents are doing everything possible to keep passengers informed, ultimately it will be passengers’ responsibility to know what is required of them. In all cases an Unabridged Birth Certificate will be required for minors departing and arriving in South Africa. They will not be allowed to travel without it.
Drivers Licence & Car Hire: The driver of the vehicle must have a valid credit card and drivers license when collecting the vehicle. Always take your South African drivers licence along with your international drivers licence when renting vehicles overseas.
Travel Documents
Travel documents include amongst others, airline tickets, hotel vouchers, tour vouchers or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel documents may be subject to certain conditions and/or restrictions including but not limited to others being non-refundable, non-date-changeable and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. It is pertinent to review your travel documentation carefully and advise us immediately of any errors in names, dates or timings.
Travel Insurance
It is strongly advised that all Clients take out adequate insurance cover such as cancellation due to illness, accident or injury, personal accident and personal liability, loss of or damage to baggage and sports equipment (Note that this is not an exhaustive list). The Travel Agent will not be responsible or liable if the client fails to take adequate insurance cover.
Please note that various credit card companies offer limited levels of travel insurance, which the Travel Agent does not consider sufficient cover for international travel. Kindly check with the relevant credit card companies to obtain the details of the cover offered.
Health
You must ensure that you are aware of any health requirements and recommended precautions relevant to your travel and ensure that you carry all necessary vaccination documentation. Check with the relevant embassy whether you may leave the airport during stopovers in countries on route to your final destination, requirements may vary from those at your final destination. In some cases, failure to present required vaccination documentation (e.g. proof of Yellow Fever vaccination) may deny you entry into a country. We recommend that you consult with your local doctor, travel medical service or specialist vaccination clinic before commencing your travel.
Cancellations and Payments:
It will depend on the rules of your ticket or the rules of the third party supplier supplying your product if you will be able to cancel or change your booking. Name changes are not permitted by Airlines and travel arrangements are not transferable. Please check with your travel agent about any penalties you might have to pay to change your booking, or whether you will be able to change your booking at all. All changes must be agreed to in writing by yourself, all fees relating to the change will be payable by you, before any changes will be made to your booking.
Cancellation penalties will be payable, depending, amongst others, on when you cancel, the suppliers’ cancellation policy and the fare rules. These cancellation fees can be as much as 100%. Please check with your travel agent prior to booking if you are able to get a refund. If you do not make your flight or arrive late, you will be marked as a no-show and will lose your flight and any possible refund.
Your contract with your Suppliers may allow them to cancel or amend bookings. If we are your Booking Agent, we will ensure that you are promptly notified of any significant changes once we become aware of such change if there is time before your departure but we accept no liability for any changes or associated costs. Subject to the Supplier’s terms and conditions, you will then have the choice of accepting the change of arrangements, accepting an offer of alternative travel arrangements if one is made available by the Supplier, or cancelling your booked arrangements and receiving any applicable refunds. We do not guarantee that any refunds will apply.
Schedule Changes
If you have booked a flight and we are alerted to a significant schedule change by your airline before you leave the country, we will contact you by email to advise you of this. Please ensure that you have given your contact email address to us and that you regularly check for messages before you leave. We have no control over airline schedule changes and accept no liability for costs which may arise as a result of such changes.
After you have left the country, it is your responsibility to check with the airline that any onward flights you have confirmed are operating as booked. We strongly recommend that you contact your airline at least 24 hours before the scheduled departure of each flight to do this.
Taxes
Airline taxes are subject to change and are confirmed at the time your airline ticket is issued. There may also be a local tax charged at some airports.
Third Party Service Providers
Agent
Kaross is acting as intermediary or a “Booking Agent” for products and services that are not directly supplied by us (e.g., air carriage and ground transportation, hotel accommodations, meals, tours, cruises, etc.). We are not a co-vendor of such products and services. You will be entering into a separate contract with such Suppliers in connection with such products and services.
Kaross represents the Principal as agents only AND ACCORDINGLY ACCEPTS NO LIABILITY for any loss, damage (including loss of profits or consequential or special damages), injury, illness, harm or death (except if such loss or damage arises from the gross negligence or wilful misconduct of Kaross or any person acting for or controlled by Kaross) which any Client may suffer as a result of any act or omission on the part of or the failure of the Principal to fulfil their obligations, whether in relation to travel arrangements, accommodation or otherwise. The contract in use by the Principal (which is often constituted by the ticket issued by the Principal), shall constitute the sole contract between the Principal and the Client and any RIGHT OF RECOURSE the Client may have, will be solely against the Principal. Kaross shall, as soon as possible after the confirmation of the Client’s booking, provide to the Client the identity of the Principal and to the extent possible, a copy of the terms and conditions applicable to the Client’s booking with the relevant Principal(s). It is the Client’s responsibility to familiarize themselves with such terms and conditions (‘the Principal’s Conditions’).
For clarity, the Services do not include any advisory or consultancy services.
Liability
To the extent permitted by law, we do not accept any liability in contract, tort or otherwise for any injury, damage, loss (including consequential loss), delay, additional expense or inconvenience caused directly or indirectly by the acts, omissions or default, whether negligent or otherwise, of third party providers over whom we have no direct control, force majeure or any other event which is beyond our control or which is not preventable by reasonable diligence on our part.
Special Requirements
Please liaise with your consultant regarding any special requirements you may have for your travel arrangements such as special meal and seating requests, room type or disabled access.
Frequent Flyer
When booking with one of our consultants, please let them know your frequent flyer membership details for inclusion in your booking. We cannot guarantee that the supplier will credit you with points for your booking. Keep your boarding passes for all flights, as these will be requested if a credit is queried.
Privacy Policy
We are committed to protecting your personal information. Kaross and our third party providers of travel and travel related products and services may disclose your personal information to others where directly connected with facilitating your travel arrangements and bookings and the provision of travel services and products. At all times we retain the right to monitor, retain and disclose any information as necessary to satisfy any applicable law, regulation, legal process or governmental request.
Governing Law
If any dispute arises between you and Kaross, the laws of South Africa will apply. You irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of South Africa, and waive any right that you may have to object to an action being brought in courts.
I acknowledge that I am 18 years of age or older and that I understand and have the legal capacity to enter into this contract and agree with the above terms and conditions.
